Senior Judge Sudhanshu Dhulia was heard on Friday in the High Court in the sting case of former Chief Minister Harish Rawat. After the hearing, the bench has now given a date of 30 September. Earlier, Justice RC Khulbe had set a date in October for hearing the case, but later he recused himself from the hearing.
In 2016, a private channel showed a sting of the then Chief Minister Harish Rawat. In this sting, Rawat has seen bargaining with MLAs to save the government.
During this period some Congress MLAs joined BJP and the state was under President’s rule. The matter of imposing President’s rule first reached the High Court and later the Supreme Court, consequently, the Rawat government was restored.
At the last hearing on September 20, in the single bench of High Court Judge Justice RC Khulbe, Harish Rawat’s counsel DD Kamath, VBS Negi, Avtar Singh Rawat, arguing that the CBI’s preliminary inquiry report filed in the case was invalid. At the same time, the government of India and CBI advocate Rakesh Thapliyal argued against taking this report into the record. Article 356 was also debated in the court. After hearing the debate for about half an hour, the date for the next hearing was delayed. It is noteworthy that the CBI had earlier submitted its report to the court. In which CBI has said that they are going to register an FIR against Harish Rawat. At the same time, Rawat’s lawyer had made it clear that there is no question of the arrest.
